Introduction
This website (the “Website”) and the Eventixo apps are owned and operated by [Company Legal Name] (Company Registration Number [Registration Number]), trading as Eventixo. Together with your Eventixo account, the organiser backoffice, our mobile apps (including the Eventixo Scanner app) and the tickets and wallet passes we issue, we call these the “Platform”.
Throughout these Terms and Conditions (“Terms”), references to “Eventixo”, “we”, “us” or “our” refer to the company operating under the Eventixo brand. References to “you” or “your” refer to any individual accessing or using the Platform or purchasing tickets or registrations through it.
These Terms govern your access to and use of the Platform, including the purchase of tickets and registrations for events advertised on it. Additional terms and conditions may be imposed by individual event organisers, promoters or venue operators. Such terms may apply alongside these Terms; they are linked from the event page or checkout, and it is your responsibility to review them before completing a purchase. Organisers using Eventixo to sell tickets are also bound by a separate organiser agreement.
By accessing the Platform, creating an account, purchasing tickets or registering for an event, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree with any part of these Terms, you should refrain from using the Platform or purchasing tickets through it. How we handle personal data is explained in our Privacy Policy.
Eventixo may amend or update these Terms. Changes will be published on the Website with a new “last updated” date and apply to subsequent use of the Platform; where a change materially affects account holders, we will also tell you by email or in the app. Your continued use of the Platform after publication constitutes acceptance of the changes. The Terms in force when you buy tickets apply to that purchase, and changes will not retrospectively remove any statutory rights or contractual protections applicable to purchases already completed.
1. About Eventixo and our services
1.1. Eventixo operates an online ticketing platform that enables event organisers, promoters and other authorised ticket sellers (collectively “Event Organisers”) to advertise events, manage registrations, sell tickets through dedicated event pages, and check tickets at the door.
1.2. Eventixo provides the technical infrastructure necessary to facilitate ticket sales, including access to secure electronic payment processing services, ticket delivery and door-scanning tools.
1.3. Unless expressly stated otherwise, Eventixo acts solely as a ticketing intermediary and agent on behalf of the relevant Event Organiser. Eventixo is not the organiser, promoter, producer or operator of the events advertised on the Platform. Your contract for the event is with the Event Organiser.
1.4. The Event Organiser’s name, address and contact details are displayed on the event page, at checkout, on your order and on your tickets. Tickets may be subject to additional terms and conditions established by the Event Organiser or venue operator.
1.5. Ticket prices, ticket categories, availability, sales dates, event schedules, refund policies and admission policies are determined by the relevant Event Organiser. Eventixo does not independently establish or control these arrangements.
1.6. Event pages, descriptions and images are provided by Event Organisers, who are responsible for their accuracy and lawfulness. Some may be created with the help of AI tools that Eventixo makes available to organisers; the organiser remains responsible for what they publish.
1.7. Any enquiries, disputes, complaints or claims relating to the event itself, including its organisation, performance, cancellation, postponement or substantial modification, remain primarily the responsibility of the relevant Event Organiser. You can contact them using “Contact the organiser” on your order.
1.8. To the fullest extent permitted by applicable law, Eventixo shall not be held responsible for the acts, omissions, decisions or contractual obligations of Event Organisers or venue operators. Nothing in this provision excludes Eventixo’s liability for its own obligations or responsibilities under applicable law.
2. Your Eventixo account
2.1. You can buy tickets without an account. An account lets you see all your tickets and orders in one place, manage your details and preferences, and save events.
2.2. You must be at least [minimum age] years old to create an account. You must give accurate information and keep it up to date, and you may hold only one personal account.
2.3. You are responsible for keeping your password and sign-in methods secure and for activity on your account. Tell us immediately at [email protected] if you think someone else has accessed it.
2.4. Orders placed with the email address on your account are shown in it. If you change your email address, orders made with your old address can still be found with “Find my tickets”.
2.5. You may close your account at any time from your account settings. Closing your account does not cancel or refund valid tickets, and Event Organisers keep the order records they are legally required to keep.
2.6. We may suspend or close an account in the circumstances described in section 13, or after a long period of inactivity with prior notice.
3. Ticket purchases and event admission
3.1. By purchasing tickets or completing a registration through Eventixo, you agree to comply with these Terms and any additional terms established by the relevant Event Organiser or venue operator.
3.2. Your purchase is complete, and a contract with the Event Organiser is formed, when payment is confirmed and we send your order confirmation. Free tickets are confirmed when we send your confirmation.
3.3. Tickets you select are held for you for a limited time (normally 10 minutes, which you may be able to extend once). If the time runs out before you complete payment, the tickets are released to other buyers.
3.4. Event Organisers may limit how many tickets can be bought per order, per person or per email address, and tickets may be sold in releases or tiers at different prices. For seated events you choose your seats on a seat map, and the organiser may prevent choices that leave single empty seats.
3.5. For high-demand sales a waiting room may be used. Everyone who joins before sales open is given a random place in the queue, and later arrivals join at the back. A place in the queue does not guarantee that tickets will be available. Refreshing, using several devices or browsers, or using automated tools does not improve your place and may lead to your access being removed.
3.6. Promo codes are issued by Event Organisers, may be limited to certain tickets, dates, numbers of uses or email addresses, have no cash value and cannot be applied after purchase.
3.7. Eventixo reserves the right to cancel and refund a transaction where an obvious pricing error, technical malfunction or administrative mistake has occurred. Where appropriate, you may be offered the opportunity to complete a new transaction at the correct advertised price, subject to applicable law.
3.8. Event Organisers reserve the right to make reasonable changes to an event, including changes to its programme, performers, seating arrangements, audience capacity or other operational details, subject to applicable consumer protection laws.
3.9. Event Organisers and venue operators may refuse admission or remove individuals from an event where reasonable grounds exist, including but not limited to:
- Intoxication or behaviour that poses a risk to others.
- Disorderly, abusive, threatening or antisocial conduct.
- Failure to comply with lawful instructions issued by authorised event or venue personnel.
- Presentation of invalid, duplicated, cancelled or insufficient tickets.
- Failure to provide identification where required, including identification matching the name on a named ticket.
- Failure to meet the event’s age restrictions.
- Failure to comply with applicable health, safety or security requirements.
3.10. You are responsible for providing accurate personal and contact information, including a valid email address, when making a purchase. Eventixo shall not be responsible for delivery issues arising from incorrect information supplied by you, except where otherwise required by law.
3.11. Failure to attend an event, arrive on time or present a valid ticket does not automatically entitle you to a refund, replacement or exchange.
4. Your tickets
4.1. Tickets are delivered electronically by email and are available in your account or through “Find my tickets”. You may also add them to Apple Wallet or Google Wallet, or download a PDF. You are responsible for ensuring that your tickets are accessible and ready for presentation upon entry, whether on your phone or in printed form where accepted.
4.2. Each ticket has a unique QR code. It admits one person once: the first valid scan at the door admits the holder, and any copy of the same ticket will be refused. Keep your tickets private and do not share images of them.
4.3. Some events require named tickets. You must add the name of each person attending before the event, and the name must match their identification at the door. Names can be changed from your order until the organiser’s cut-off, where one applies.
4.4. You may send a ticket to a friend using “Send to a friend”. On named-ticket events, the ticket is handed over and your friend adds their own name. You remain responsible for tickets you send until they are used.
4.5. Tickets are for personal use. Unless the Event Organiser expressly allows it, tickets may not be resold, offered for resale, or used for advertising, promotions, prizes or competitions. Tickets obtained or sold in breach of this section may be cancelled without refund.
5. No cooling-off period
5.1. Tickets are a leisure service for a specific date. Under the Consumer Rights Directive (EU) 2011/83 and Maltese law, the 14-day right to withdraw from distance contracts does not apply. Once your order is confirmed, you cannot cancel it simply because you change your mind; refunds are available only under the event’s refund policy (section 8) or as required by law.
6. Payments, pricing and fees
6.1. Payments made through Eventixo are processed by authorised payment service providers (Viva Wallet or Stripe, depending on the event), on their own secure pages. Payment is made to the Event Organiser’s account. Eventixo never receives your full card details.
6.2. Ticket purchases may be subject to a booking fee per ticket. Every price is shown including the booking fee and VAT from the first price you see, and the full total is shown before you pay.
6.3. Whether booking fees are refunded is set out in each event’s refund policy, shown before you pay. Where an event is cancelled, or where required by law, booking fees are refunded along with the ticket price.
6.4. Unless otherwise specified, all prices are quoted in Euro (€) and include Value Added Tax (VAT) where applicable.
6.5. A receipt showing VAT is sent with your order, and a tax invoice is available from your order where required by applicable law.
6.6. By completing a transaction, you authorise payment of the total amount displayed at checkout, including any applicable taxes and fees.
6.7. If you dispute a payment with your bank or card provider (a chargeback), the related tickets are cancelled and may no longer be used. Please contact us or the Event Organiser first so we can try to resolve the issue.
7. Event cancellations, postponements and changes
7.1. The relevant Event Organiser is primarily responsible for decisions concerning the cancellation, postponement, rescheduling or modification of an event.
7.2. If an event is cancelled, you will be offered a full refund of the price you paid, to the original payment method.
7.3. If an event is postponed or rescheduled, your tickets remain valid for the new date. If you cannot attend the new date, any refund will be in accordance with the event’s refund policy, the Event Organiser’s terms and applicable consumer protection legislation; where the organiser offers refunds for a postponement, the deadline will be communicated to you.
7.4. Where an event is materially changed, any refund, replacement ticket or alternative arrangement shall be determined in accordance with the Event Organiser’s terms and applicable consumer protection legislation.
7.5. As Eventixo acts as an intermediary, responsibility for providing refunds or alternative event arrangements generally rests with the Event Organiser, except where Eventixo has a separate legal obligation. Eventixo processes refunds on the organiser’s instructions.
7.6. To facilitate communication regarding your purchase, Eventixo shares relevant contact details with the Event Organiser for legitimate event-related purposes, including updates about event changes, admission requirements, cancellations or postponements. Event Organisers are not authorised to use personal information obtained through Eventixo to send unsolicited marketing without an appropriate lawful basis.
7.7. Eventixo and the Event Organiser will make reasonable efforts to inform affected ticket holders of significant event changes using the contact information provided at the time of purchase, but cannot guarantee that every ticket holder will receive such notifications before the scheduled event date. Ticket holders are encouraged to monitor the event page and the organiser’s official channels for the latest information.
8. Refunds, exchanges and replacement tickets
8.1. Each event has a refund policy set by the Event Organiser and shown on the event page, at checkout and on your order. It will be one of: no refunds (unless the event is cancelled); refunds until a stated number of days before the event; or refunds until the event starts, and states whether booking fees are refunded.
8.2. Unless the event’s refund policy allows it or applicable law requires it, all ticket purchases are final and non-refundable.
8.3. Where the policy allows, you can request a refund from your order before the deadline. Approved refunds are made to the original payment method, and the refunded tickets are cancelled. The time for the money to reach you depends on your bank or card provider.
8.4. Refunds or exchanges will not ordinarily be provided for circumstances including:
- A change in your personal circumstances or plans.
- Inability or failure to attend the event.
- Accidental purchases or selection of an incorrect ticket category.
- Failure to arrive before the event’s admission deadline.
- Failure to comply with the event’s entry requirements.
- Lost, stolen, damaged or misplaced tickets.
These exclusions are subject to any mandatory consumer rights and statutory protections.
8.5. Because tickets are electronic, they can be re-sent or re-downloaded from your order at no charge. Where a ticket is lost, stolen or compromised, Eventixo may, at its discretion and where technically possible, cancel the original ticket and reissue it. Replacement tickets may only be issued where the original transaction can be verified and the original ticket can be invalidated or otherwise securely identified.
8.6. Eventixo reserves the right to charge a reasonable administration fee for ticket replacement or reissuance, provided that any such fee is disclosed in advance and permitted by applicable law.
8.7. Nothing in these Terms affects any refund or other rights that cannot lawfully be excluded under applicable consumer protection legislation.
9. Our apps
Licence
9.1. Eventixo grants you a personal, non-exclusive, non-transferable, revocable licence to install and use our apps on devices you own or control, for the purposes they are provided for and in line with these Terms. The apps are licensed, not sold.
9.2. You must not copy, modify, decompile, reverse engineer or attempt to extract the source code of our apps, bypass their security features, or use them to access data you are not authorised to see, except to the extent the law allows this.
9.3. We may release updates that fix problems or change features. Some updates may be required to keep using an app. Apps are provided for current supported versions of iOS and Android.
The Eventixo Scanner app
9.4. The Eventixo Scanner app is provided for Event Organisers and their authorised staff to check tickets. A device may only be used with a pairing code issued by an Event Organiser, for that organiser’s events.
9.5. Pairing codes are confidential. Do not share them with anyone who is not authorised by the Event Organiser. The Event Organiser is responsible for the people and devices it authorises, for the instructions it gives them, and for telling its staff how their data is used.
9.6. Scanner devices may hold ticket information, including holder names, to work without a connection. Users must keep paired devices secure, must not copy or export ticket information from them, and must report a lost or stolen device to the Event Organiser so it can be revoked. Revoked devices are wiped on their next connection.
9.7. When scanning offline, results are based on the information last downloaded to the device and are reconciled when it reconnects. Eventixo is not responsible for admission decisions taken by door staff.
App stores
9.8. Your use of an app downloaded from the Apple App Store or Google Play is also subject to that store’s terms. If you downloaded an app from the Apple App Store:
- These Terms are between you and Eventixo, not Apple. Eventixo, not Apple, is solely responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Eventixo, not Apple, is responsible for addressing any claims relating to the app or your possession and use of it, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer protection claims.
- Eventixo, not Apple, is responsible for the investigation, defence, settlement and discharge of any third-party claim that the app or your use of it infringes that third party’s intellectual property rights.
- You confirm that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as they relate to the app.
10. Prohibited and unauthorised activities
By accessing or using the Platform, you agree not to engage in any activity that may compromise the security, functionality, integrity or lawful operation of Eventixo. In particular, you must not:
10.1. Use the Platform to facilitate illegal, fraudulent or otherwise unauthorised ticket sales, resale activities or transactions.
10.2. Resell tickets through unauthorised websites, embedded pages or third-party platforms where such resale is prohibited by the applicable ticket conditions or law.
10.3. Interfere with, disrupt, damage or compromise the operation, performance or security of the Platform or any associated system.
10.4. Place an unreasonable or excessive burden on the Platform’s infrastructure, servers or transactional systems.
10.5. Access more than 1,000 Website pages within any 24-hour period, or send automated requests to transactional servers more frequently than once every three seconds, without prior written authorisation. These restrictions also apply to coordinated activity involving multiple individuals or accounts.
10.6. Use automated systems, including bots, scripts, spiders, crawlers or similar technologies, to purchase, reserve, queue for or otherwise process tickets without prior written authorisation.
10.7. Try to get around waiting rooms, bot checks, ticket holds or purchase limits, for example by using multiple accounts, email addresses, payment cards or devices to obtain more tickets than allowed.
10.8. Copy, forge, alter or duplicate tickets or QR codes, or attempt to use a ticket that has been cancelled, refunded or already scanned.
10.9. Attempt to gain unauthorised access to the Platform, its databases, payment infrastructure, accounts, apps, scanner devices or connected systems.
10.10. Use the Platform for any unlawful, deceptive, fraudulent or malicious purpose.
Eventixo reserves the right to investigate suspected violations and take appropriate action in accordance with these Terms and applicable law.
11. Website usage and intellectual property
11.1. The Platform is provided primarily for personal, lawful and non-commercial use, including browsing events, purchasing tickets and managing event registrations. Event Organisers and their staff may use the organiser tools under their organiser agreement.
11.2. You may temporarily download or store content where reasonably necessary for personal viewing and legitimate use of the Platform.
11.3. Unless expressly permitted by law or authorised in writing by Eventixo, you may not reproduce, distribute, publish, modify, commercially exploit or create derivative works from any material available on the Platform.
11.4. All Platform content, including text, graphics, photographs, designs, logos, software, apps, layouts and other materials (collectively “Content”), is owned by Eventixo or used under appropriate licence, permission or authorisation. Event content is provided by, and remains the property of, the relevant Event Organiser.
11.5. Such Content is protected by applicable intellectual property laws in Malta and, where relevant, other jurisdictions and international agreements.
11.6. The Eventixo name, branding, logos, trade names and associated marks are proprietary assets and may be protected by trademark or other intellectual property laws. Nothing on the Platform grants you any licence or right to use them without prior written consent.
11.7. You must not remove, conceal or alter copyright notices, ownership acknowledgements, trademarks or other proprietary information displayed on the Platform.
11.8. Eventixo reserves all rights to protect and enforce its intellectual property to the fullest extent permitted by law.
12. Reporting illegal content
12.1. Eventixo hosts content provided by Event Organisers. If you believe an event page or other content on the Platform is illegal or breaches these Terms, report it using the “Report this page” link on the page or by contacting us. Please explain why you think it is illegal and where it appears.
12.2. We review reports promptly and diligently, may remove or restrict content, and will tell the person who reported it and the affected organiser what we decided and why, where the EU Digital Services Act requires it. You may ask us to review a decision by replying to our response.
12.3. Our single point of contact for authorities and users under the Digital Services Act is [Legal Contact Email]. We communicate in English.
13. Violations and enforcement
13.1. Where Eventixo reasonably believes that you have breached these Terms, participated in fraudulent activity, or acted in coordination with another person who has violated these Terms, we reserve the right to take appropriate and proportionate action.
13.2. Such action may include:
- Temporarily suspending, restricting or permanently terminating access to the Platform, an account or a scanner device.
- Cancelling suspicious, fraudulent or unauthorised ticket orders or registrations.
- Refusing future ticket purchases or registrations.
- Reporting suspected unlawful activity to relevant authorities.
- Initiating legal proceedings where appropriate.
13.3. Where tickets or registrations are cancelled as a result of a breach of these Terms, any refund entitlement will be determined in accordance with applicable law and the circumstances of the transaction.
13.4. Eventixo may take appropriate preventative action without prior notice where reasonably necessary to protect customers, Event Organisers, payment systems or the security of the Platform. Where we do, we will tell you the reasons unless the law or security considerations prevent it.
14. Disclaimer and limitation of liability
14.1. You acknowledge that your use of the Platform is subject to the inherent risks associated with online services and internet-based transactions.
14.2. Eventixo takes reasonable measures to maintain the security, reliability and availability of the Platform. However, we do not guarantee that it will operate continuously, without interruption, or free from technical errors, defects or security vulnerabilities.
14.3. Access to the Platform may occasionally be restricted, suspended or interrupted due to scheduled maintenance, system upgrades, technical failures, security incidents or circumstances beyond our reasonable control.
14.4. Eventixo reserves the right to modify, suspend or discontinue Platform features or services where reasonably necessary.
14.5. Eventixo is not liable for failure or delay in performing its obligations caused by events beyond its reasonable control, such as natural disasters, epidemics, war, terrorism, civil unrest, government action, strikes, or failures of public utilities, telecommunications networks or third-party payment systems.
14.6. To the maximum extent permitted by applicable law, Eventixo excludes warranties, representations or conditions that are not expressly stated in these Terms or otherwise required by law.
14.7. Nothing in these Terms excludes, restricts or limits any statutory rights or remedies available to consumers under applicable Maltese or European Union legislation.
14.8. Where Eventixo acts solely as an intermediary on behalf of an Event Organiser, Eventixo shall not be responsible for the organisation, execution, quality, content, safety or delivery of the event itself, except to the extent that liability arises from Eventixo’s own acts, omissions or legal obligations.
14.9. Eventixo shall not be held liable for the conduct, decisions, omissions or failures of third parties, including Event Organisers, promoters, performers, venue operators, advertisers, sponsors or other service providers, except where otherwise required by law.
14.10. Subject to applicable law, where Eventixo is found liable in connection with services provided directly by Eventixo, its liability shall be limited to the amount paid by you for the relevant services, to the extent that such limitation is legally enforceable.
14.11. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or any other liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer protection legislation.
15. Indemnification
15.1. To the extent permitted by applicable law, you agree to indemnify Eventixo against reasonable losses, costs, damages, expenses or liabilities arising directly from:
- Your unlawful or fraudulent use of the Platform.
- Your material breach of these Terms.
- Your infringement of third-party intellectual property rights.
- Your intentional misconduct or negligent actions in connection with the Platform.
15.2. This indemnification obligation applies only to the extent that the relevant loss, damage or liability is legally attributable to your actions or omissions.
15.3. Nothing in this section requires consumers to compensate Eventixo for losses resulting from Eventixo’s own negligence, misconduct or failure to comply with applicable law.
16. Complaints and disputes
16.1. If you have a problem with the event itself, please contact the Event Organiser first, using “Contact the organiser” on your order. For anything about the Platform, your account or a payment, contact us using the details in section 18. We aim to reply within [number of] working days.
16.2. If we cannot resolve your complaint, you may contact the Malta Competition and Consumer Affairs Authority (MCCAA) or, for a cross-border complaint within the EU, the European Consumer Centre Malta, who may be able to help. You may also refer it to [alternative dispute resolution body].
17. General provisions
17.1. Governing law. These Terms shall be governed by and interpreted in accordance with the laws of Malta.
17.2. Jurisdiction. Any dispute arising in connection with these Terms shall be subject to the jurisdiction of the competent courts of Malta, without prejudice to any mandatory jurisdictional rights available to consumers under applicable European Union or other relevant legislation, including the right to bring proceedings in the courts where you live.
17.3. Severability. If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision shall be severed or limited to the minimum extent necessary, without affecting the validity or enforceability of the remaining provisions.
17.4. Waiver. Failure by Eventixo to enforce any provision of these Terms shall not constitute a waiver of its right to enforce that provision or any other provision in the future.
17.5. Assignment. Eventixo may transfer its rights and obligations under these Terms to another organisation, provided this does not reduce your rights. You may not transfer your rights or obligations without our written consent.
17.6. Communications. We will communicate with you electronically, by email or through the Platform, and you agree that electronic communications satisfy any legal requirement for communications in writing.
17.7. Language. These Terms are provided in English. If they are translated, the English version prevails to the extent permitted by law.
17.8. Entire agreement. These Terms, together with our Privacy Policy and any additional conditions expressly applicable to a particular event or transaction, constitute the agreement governing your use of the Platform and the relevant ticketing services.
